This Agreement is entered into by and between the below-named homeowner (“Client”) and Trusted Remodel Advisor (“Advisor”), for the provision of advisory services (“Service”) related to the Client’s home remodeling project. Advisor will provide independent advice and guidance, and Client agrees to retain Advisor under the following terms.

1. Welcome!

Advisor is here to help Client make informed remodeling decisions. This Agreement clarifies the relationship between Advisor and Client. By engaging Advisor’s Service, Client agrees to these terms. If Client does not agree, Advisor cannot provide the Service.

2. Scope of Services

Advisor provides independent remodeling advice, as described on the previous page detailing available service levels. The scope of services is strictly limited to the descriptions provided on that page.

What Advisor Does Not Do:

• No Design or Engineering Services: Advisor does not provide architectural, design, engineering, structural analysis, or building management services. Any insights provided are for informational purposes only and should not be construed as professional design or engineering work.
• No Legal or Financial Advice: Advisor is not an attorney, accountant, or financial advisor. Any written or verbal recommendations should not be interpreted as legal, tax, or financial advice. Client should consult appropriate licensed professionals for such matters.
• No Project Management or Oversight: Advisor does not perform on-site inspections, manage contractors, or supervise work performed by third parties. Client is solely responsible for overseeing the project.

3. Fees and Payment

The fee for the Service is based on the Small, Mid-size, or Large package selected on the previous page.

Payment is due in full upon execution of this Agreement.

Accepted payment methods will be specified.

All payments are non-refundable, except in cases where Advisor fails to deliver agreed-upon services.

Advisor may update service fees, with prior notice posted on the website.

Advisor is an independent consultant and is not a party to any agreement between Client and any contractor or third party involved in Client’s project.

4. Client’s Responsibilities

Client is responsible for:

Making final decisions about the remodel.

Providing Advisor with complete and accurate project information.

Communicating directly with contractors, suppliers, and third parties.

5. Important Disclaimers

Scope of Services Reference: The scope of services provided is based only on the descriptions outlined on the previous page. No additional or implied services are included beyond those specified in the selected package. Advisor does not provide any service descriptions beyond what was reviewed at the time of purchase. Clients are responsible for reviewing and understanding the service details before purchase.

Cost Estimates: Any budgetary guidance or cost estimates provided by Advisor are based on industry trends and general market conditions. Advisor does not guarantee accuracy or that any contractor’s proposal will align with these estimates. Market fluctuations, supply chain issues, or unforeseen factors may affect costs.

Contractor Selection: Advisor may provide guidance on selecting contractors, but Client is solely responsible for vetting, hiring, and managing third parties. Advisor does not endorse, guarantee, or assume responsibility for any contractor’s performance, work quality, or contractual obligations.

Information Accuracy: While Advisor strives to provide reliable and up-to-date advice, construction trends, material costs, and regulations change frequently. Advisor is not liable for outdated or incomplete information.

Limitation of Liability: Advisor’s total liability, under any circumstance, is limited to the amount paid by Client for the Service. Advisor is not liable for project delays, cost overruns, defective workmanship, or any direct, indirect, incidental, or consequential damages related to Client’s remodel.

6. Intellectual Property

Any reports, advice, or documents provided by Advisor (“Work Product”) remain Advisor’s intellectual property.

Client is granted a perpetual, royalty-free, non-transferable license to use Work Product solely for Client’s personal remodel.

Work Product may not be reproduced, distributed, or used for commercial purposes without Advisor’s written consent.

This provision survives termination of this Agreement.

7. Dispute Resolution

Any dispute between Advisor and Client shall be resolved through binding arbitration in Pima County, Arizona, under the rules of the American Arbitration Association.

No lawsuits or jury trials—this process is intended to be efficient and straightforward.

8. Governing Law

This Agreement is governed by the laws of the State of Arizona.

9. Updates to This Agreement

Any changes to this Agreement must be in writing and agreed upon by both Advisor and Client.

10. Termination of Agreement

Either party may terminate this Agreement at any time by providing written notice.

Advisor may also terminate the Agreement if Client violates its terms or acts in a manner detrimental to Advisor’s business.

The Agreement will be deemed terminated upon the completion of services and delivery of final reports.

11. Indemnification

Client agrees to indemnify, defend, and hold harmless Advisor from any claims, damages, losses, or legal fees arising from:

Client’s use of Advisor’s recommendations.

Any actions or omissions of contractors, vendors, or third parties hired by Client.

Any aspect of Client’s remodeling project, including but not limited to construction delays, defects, property damage, or cost overruns.

12. Agreement to Terms

Client acknowledges that they have read, understood, and agreed to these terms.
